Centennial Rewards Program Terms of Use

Effective Date: January 1, 2017

1. You are automatically enrolled in Centennial Rewards

The Centennial Rewards Program is made available to you by your Medicaid Health Plan and the New Mexico Human Services Department ("HSD"). Centennial Rewards is administered by Finity Communications, Inc. (dba Finity, Inc.). Centennial Care members are automatically enrolled in the Rewards Program.

2. Earn points for completing healthy activities

The Centennial Rewards Program lets you earn points when you complete certain health activities. After you register, go to the Earn section for more information. HSD may decide to change the health activities at any time. It is your responsibility to check the Centennial Rewards website to learn about the current specific health activities that can earn rewards.

3. Exclusions and restrictions may apply

Centennial Care Rewards may be subject to certain exclusions and restrictions. Your health plan makes the final decision about all Centennial Care Rewards eligibility and award criteria.

4. Communication medium preference

You will be asked to choose your communication preference when you register for the Centennial Rewards Program. This will tell us how to send you certain communications. You may also receive communications in different mediums as required by the program. The choices are text message, email, auto call, web, or mail. You can change your communication medium preference in the My Account section of this website at any time.

5. Centennial Rewards Program Rules

These Terms of Use explain the rules that are in effect when you take part in the Centennial Rewards Program. The rules apply to use of the Centennial Rewards website, Centennial Rewards Member Services, and other Centennial Rewards services.

Please be aware that there may be different Terms of Use and Privacy Policies when you use your Medicaid Member Portal or other Health Plan websites and services.

6. The program rules may change

The Centennial Rewards Program rules may be changed at any time without prior notice to you. Any changes will take effect as soon as they are posted on this website. You should check from time to time to see if there are any updates. You agree to the changes by using the website after changes have been posted.

7. Annual Dental Check-Up Rewards (Adult)

You may be eligible to earn $25 (250 points) each calendar year for a dental visit. The following rules apply:

Age 18 or older by December 31 of the current year

At least one dental visit during the current year

8. Annual Dental Check-Up Rewards (Child)

Your children may be eligible to earn $35 (350 points) each calendar year for a dental visit. The following rules apply:

Age 2-17 by December 31 of the current year

At least one dental visit during the current year

9. Step-Up Challenge Rewards

You may be eligible to earn up to $50 (500 points) if you successfully complete the Step-Up Challenge walking program. The following rules apply:

Age 10 or older

You must complete the 3-week challenge before registering for the 9-week challenge

3-Week Challenge: Successfully complete the 3-week Step-Up Challenge and earn $25 (250 points) in rewards. Track 5,000 daily steps for at least 6 days in Week 1, 7,500 daily steps for at least 6 days in Week 2, and 10,000 daily steps for at least 6 days in Week 3.

9-Week Challenge: Successfully complete the 9-week Step-Up Challenge and earn an additional $25 (250 points) in rewards. Set your own goal of 5,000 or more steps per day.

10. Healthy Babies & Pregnancy Reward

You may be eligible to earn $100 (1,000 points) if you are pregnant. The following rules apply:

Must be pregnant

Must join your health plan's prenatal program during the current year

If you are age 17 or under, eligible rewards are awarded to your parent or legal guardian

If you are age 18 or older, eligible rewards will be given to you

11. Asthma Medication Management Rewards

You may be eligible to earn $5 (50 points) per prescribed refill of your child's asthma controller medication, up to a maximum of $60 (600 points) per calendar year. The following rules apply:

Child aged 5-17 by December 31 of the current year

Current diagnosis of persistent asthma

Refill your child's asthma controller as prescribed

Earn $5 (50 points) per prescribed refill, up to $60 (600 points) per calendar year

12. Diabetes Management Rewards

You may be eligible to earn $20 (200 points) for getting any of three tests as directed by your doctor to help manage your diabetes, up to a maximum of $60 (600 points) per calendar year if you get all three tests. The following rules apply:

Age 10-75 by December 31 of the current year and diagnosed as having type 1 or type 2 diabetes

Hemoglobin HbA1c test during the current year: $20 (200 points) per calendar year

Eye exam during the current year: $20 (200 points) per calendar year

Nephropathy exam to check your kidney function during the current year: $20 (200 points) per calendar year

13. Bipolar Disorder Medication Management Rewards

You may be eligible to earn $5 (50 points) per prescribed bipolar disorder medication refill, up to $60 (600 points) per calendar year. The following rules apply:

Age 18-64 by December 31 of the current year

Diagnosed with bipolar disorder

Take bipolar disorder management medication as prescribed by your doctor during the current year

Earn $5 (50 points) per prescribed refill, up to $60 (600 points) per calendar year

14. Schizophrenia Medication Management Rewards

You may be eligible to earn $5 (50 points) per prescribed schizophrenia medication refill, up to $60 (600 points) each calendar year. The following rules apply:

Age 18-64 by December 31 of the current year

Diagnosed with schizophrenia

Take schizophrenia management medication as prescribed by your doctor during the current year

Earn $5 (50 points) per prescribed refill, up to $60 (600 points) per calendar year

15. Bone Density Testing Rewards

You may be eligible to earn $35 (350 points) for a bone density test. This reward is available once per lifetime. The following rules apply:

Female

Aged 65 or older by December 31 of the current year

Bone mineral density test during the current year

16. Reward Queries

You have the right to file a query if you do not receive a reward that you believe you earned. Go to the My Account section of the Centennial Rewards website to begin a query.

17. Rules & Restrictions

The following rules and restrictions apply to all incentives, points, and rewards made available through the Centennial Rewards Program.

a. You must be enrolled in Centennial Care

You must be enrolled in Centennial Care to take part in the Centennial Rewards Program. Your Centennial Rewards points go with you if you switch to another Centennial Care Medicaid Health Plan. If you are no longer enrolled in Centennial Care, you cannot earn new reward points. Any reward points you have already earned must be used within 12 months after your eligibility ends.

b. Points expire at the end of the next calendar year

Centennial Rewards points expire at the end of the following calendar year after you receive them. For example, any reward points received in 2017 will expire on December 31, 2018.

c. Points and rewards may be changed at any time

The incentives, points, and rewards offered through the Centennial Rewards Program are SUBJECT TO CHANGE, TERMINATION, OR CANCELLATION AT ANY TIME WITHOUT PRIOR NOTICE.

d. Rewards items may be replaced

If an item in the catalog is unavailable for any reason, the Centennial Rewards Program reserves the right to replace it with another item of similar value. Or we may contact you and ask you to choose another item.

e. No returns for items damaged during use

The Centennial Rewards Program is not responsible for any damage caused to reward items after you have received them.

f. We are not responsible for defective items

You must contact the company or manufacturer directly if a reward item is defective. The Centennial Rewards Program is not responsible for any harm that results from your use of a reward item, even if it is defective.

g. Damaged items must be returned within 10 business days

Damaged items must be returned within 10 business days after the date of the postmark. Call us at 1-877-806-8964 to request a return label or ask the carrier to return the package to sender. The item must be returned in the original packaging. We will replace the damaged item with the same item if it is available. You may need to choose a different item if the item you ordered is no longer available.

h. All reward orders are final

All orders are final. No returns or exchanges are allowed if you decide you don't like the item you ordered.

i. Make sure to use your correct address

You must provide the correct address when you place an order. Items will not be re-sent if our tracking report shows that the package was delivered to the address you provided.

j. Contact us if an order is not delivered

Call us at 1-877-806-8964 if you provided the correct shipping address and did not receive your order. Check your address carefully when placing an order. Items will not be re-sent if you gave us an incorrect address.

k. You may be required to sign upon delivery

Signatures may be required for orders of $75 or more. Please make sure to provide a shipping address where you will be available to sign upon delivery. You can choose to waive the signature requirement when you place an order. Items will not be re-sent if you waive the signature and the package is stolen.

l. Centennial Rewards may be taxable

Centennial Rewards may be subject to federal and state income taxes. You are responsible for reporting any taxable amounts on your tax returns. Ask a tax advisor for more information.

m. Centennial Reward Points have no cash value

Centennial Reward Points have NO CASH VALUE. The points are given to you for completing certain healthy behaviors. You can use your reward points to purchase healthy items from the Centennial Rewards Catalog.

n. Points may be cancelled for fraud or dishonesty

The information you provide when you take part in the Centennial Rewards Program and redeem reward points must be factual, accurate, and complete. Incentives, points, and rewards may be cancelled if you break or attempt to break any Rewards Program rules.

18. Taking part is AT YOUR OWN RISK

The Centennial Rewards Program and the Centennial Rewards website are provided AS IS and AS AVAILABLE, without any warranty, guarantee, or representation of any kind. Your use of the Centennial Rewards website and participation in the Centennial Rewards Program is done AT YOUR OWN RISK. The Centennial Rewards Program provides general information only. The information provided is not guaranteed to be accurate, timely, or appropriate for you or anyone else.

19. No medical advice, diagnosis, or treatment

The Centennial Rewards Program does not provide medical advice, diagnosis, or treatment. You should not use any information provided by the Centennial Rewards Program as a substitute for medical advice, diagnosis, or treatment. If you have a medical need, consult your doctor or other qualified healthcare provider. If you have a medical emergency, call 911 or go to an emergency or urgent care facility.

Your Health Plan, HSD, and Finity are not responsible for any injury, illness, death, or other outcome that may result if you take part in the program.

20. Talk to your doctor for any healthcare needs

The Centennial Rewards Program does not provide health, financial, legal, tax, fiduciary, or other advice. You should consult your primary care provider or other qualified healthcare professional before participating in any exercise, nutrition, or wellness-related program or activities, whether or not you have a known health condition or risk factors. Regular check-ups and care from a qualified healthcare professional are important parts of any health and wellness routine.

21. Compliance with laws & regulations

The Centennial Rewards Program is designed to comply with applicable laws and regulations, including HIPAA. Finity has no control over and does not accept any responsibility for the legal or regulatory policies and practices followed by HSD or your Medicaid Health Plan.

22. Centennial Rewards Program intellectual property

The Centennial Rewards Program name is the sole and exclusive intellectual property of HSD. The Step-Up Challenge, technology, and certain program design elements are the sole and exclusive intellectual property of Finity. The intellectual property rights for the Centennial Rewards Program are protected by United States and international copyright and other intellectual property laws. All rights, title, and interest in the Centennial Rewards Program are hereby reserved by their rightful owner.

Visitors to the Centennial Rewards website do not have any license or right to use any Centennial Rewards logos, copyrights, trademarks, or other intellectual property rights without the prior written permission of its rightful owner.

23. Third-party content

Some of the content, tools, and calculators available on the Centennial Rewards website may be provided and owned by third parties. Any such Third-Party Content is the exclusive intellectual property of its rightful third-party. The Centennial Rewards Program does not endorse, control, or make any representations about Third-Party Content.

24. Warranties

THE CENTENNIAL REWARDS PROGRAM AND WEBSITE ARE PROVIDED TO YOU "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

NO GUARANTEE OR WARRANTY IS MADE FOR THE CENTENNIAL REWARDS PROGRAM OR THE CENTENNIAL REWARDS WEBSITE. The Centennial Rewards Program is not liable for any damage or injury to persons or property that may result from your use of the Centennial Rewards website or the Centennial Rewards Program. We make no promise or warranty that you will be able to access or use any portion of the Centennial Rewards website. We make no warranty or guarantee that the site will be error-free or that the servers that make the website available are free of viruses or other harmful components. We disclaim any liability for any delay, failure, interruption, or corruption of any data or other information transmitted related to your use of this website.

Some jurisdictions may not allow the exclusion of implied warranties. This may mean that some of the above exclusions may not apply to you.

25. Limitation of liability

By taking part in the Centennial Rewards Program, you agree to release HSD, your Medicaid Health Plan, Finity, and their respective affiliated companies and subsidiaries, officers, directors, employees, contractors, and agents, from any loss, claims, or damages that arise from your use of or participation in any portion of the program, whether known or unknown, suspected or unsuspected, disclosed or undisclosed.

In no event shall the Centennial Rewards Program be liable for any costs, damages, or expenses (including, without limitation, any direct, indirect, incidental, punitive, special, or exemplary damages, lost profits, damages resulting from lost data or business interruption, or health problems), that may result from your use or inability to use this website, or any products or services provided through the Centennial Rewards Program, whether based on warranty, contract, tort, or any other legal theory, and whether or not we have been advised of the possibility of such damages.

Some states do not allow the exclusion of limitation of liability for consequential or incidental damages. The above limitation may not apply if you live in one of those states. The remedies under these Terms of Use are exclusive and are limited to those expressly provided for herein.

26. Consequential damages waiver

IN NO EVENT SHALL THE CENTENNIAL REWARDS PROGRAM BE LIABLE FOR ANY INCIDENTAL, INDIRECT, EXEMPLARY, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES, LOST PROFITS OR LOST DATA OR INFORMATION, OR ANY OTHER INDIRECT DAMAGES, WHETHER ARISING IN CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE RELATED TO YOUR USE OF THIS WEBSITE OR USE OF THE REWARD ITEMS PROVIDED OR YOUR USE OF OR PARTICIPATION IN THE PROGRAM. This waiver includes, without limitation, any damages in connection with economic loss, physical or mental illness or recurrence of pre-existing physical or mental illness, injury, or death as a result of your use of any reward products or participation in any of the listed activities.

27. Indemnification

You agree to hold HSD, your Medicaid Health Plan, Finity, and their respective officers, directors, agents, employees, and contractors harmless from and against any claims, actions, demands, liabilities, and settlements, including, without limitation, reasonable legal and accounting fees, resulting from, or alleged to have resulted from, your participation in the program, or use of any and all products, rewards activities, or services offered through the Centennial Rewards Program.

28. Use the program only as allowed

You are not allowed to copy, reproduce, or redistribute the Centennial Rewards website or the Centennial Rewards Program. You are not allowed to remove or change this website in any way, including but not limited to copyrights, trademarks, service marks, trade names, logos, or intellectual property.

29. If you break the rules

You must follow the rules set by the Centennial Rewards Program. We expressly reserve the right to block your use of the website or the program at any time without prior notice if you break the rules.

30. Governing jurisdiction & conflict of laws

These Terms of Use are governed by the internal substantive laws of the State of New Mexico, without respect to its conflict of laws principles. By taking part in the Centennial Rewards Program, you agree that the exclusive jurisdiction for any dispute arising from or in any way related to the program resides in the courts of Santa Fe County, New Mexico.

You further expressly consent to the exercise of personal jurisdiction in the courts of Santa Fe County, New Mexico in connection with any such dispute involving the Centennial Rewards Program affiliates, subsidiaries, employees, contractors, officers, directors, administrators, and telecommunication providers.

31. Severability

In the event that any part of these Terms of Use is found to be invalid by a court of competent jurisdiction, that part shall be deemed invalid or modified as required by such court, and the remainder of the Terms of Use shall remain in full force and effect.

32. Waiver

No waiver of any part of these Terms of Use shall be deemed a further or continuing waiver of such term or condition or any other term or condition.

33. Submission of unsolicited ideas or materials

The Centennial Rewards Program is not responsible for any unsolicited ideas, proposals, or materials submitted to us. Any such unsolicited ideas, proposals, or materials will be treated as non-confidential and non-proprietary, and will not be returned to you.

34. Entire agreement

Unless otherwise indicated, the Centennial Rewards Program Terms of Use and Centennial Rewards Program Privacy Policy constitute the entire agreement with respect to your use of the program and the Centennial Rewards website.

35. Survival

Sections 1 through 35 will survive any termination or expiration of these Terms of Use.
